Terms of Service & Registration Agreement

These Terms govern your access to and use of get.art (the "Site", "Services") — the storefront for registering .ART domain names, operated by it.com Domains LTD ("we", "us"; 20 Hammersmith Broadway, London, England, W6 7AB; company no. 14872503). By using the Site or purchasing through it, you agree to these Terms, our Privacy Notice and Cookie Policy. If you do not agree, do not use the Services.

1. The parties & the service

it.com Domains LTD is the merchant of record — the seller you contract with and pay when you buy through get.art. The get.art platform, and the customer accounts and databases, are operated, owned and controlled by UKCI Holdings Limited (Isle of Man). Domain registration and related services are provided through PublicDomainRegistry (PDR) / LogicBoxes and the .ART registry operated by UK Creative Ideas Limited. For data-protection purposes, it.com Domains LTD and UKCI Holdings Limited each act as independent controllers for their respective purposes — see the Privacy Notice.

2. Eligibility & accounts

You must be at least 16 years old and able to enter into a binding contract. You are responsible for the accuracy of the information you provide, for keeping your credentials confidential, and for activity under your account. We may suspend or terminate accounts that breach these Terms or applicable policies.

3. Domain registration

Registering a .ART domain is subject to, and you agree to be bound by:

Availability, eligibility and reserved/premium names are determined by the registry. Registration is completed only when confirmed by the registry; a pending order does not guarantee a registration.

Registrant resources (ICANN). As a registrant, you should familiarise yourself with the Registrants' Benefits and Responsibilities applicable when registering gTLD domains, and you are encouraged to refer to ICANN's Registrant Educational Materials.

.ART registry rules. .ART is a top-level domain for the arts and cultural community, and registration is subject to the .ART Registry Policies, which form part of your registration. In particular:

The .ART Registry Policies are governed by the laws of England and Wales, consistent with these Terms.

Registry indemnity. To the extent permitted by applicable law, you shall indemnify, defend and hold harmless UK Creative Ideas Limited (the registry operator for .ART) and its back-end registry services provider, and their respective officers, directors, shareholders, owners, managers, employees, agents, representatives, contractors, affiliates, successors, assigns and attorneys (the "Registry Related Parties"), from and against any and all claims made by third parties — including all loss, liability, claims, demands, damages, costs and expenses, causes of action, suits, proceedings, judgments, awards, executions and liens (including lawyers' fees on a full-indemnity basis, and claims without legal merit or brought in bad faith) — relating to or arising under your registration, and including your use, display, exploitation or registration of a domain name.

Registry as third-party beneficiary. The registry is not a party to these Terms and it.com Domains LTD does not act as agent for the registry. However, the registry and each of its affiliates are intended beneficiaries of the rights granted to them under these Terms, with the ability to enforce those rights directly against you (whether under the Contracts (Rights of Third Parties) Act 1999 or otherwise). You acknowledge that the registry, in permitting the registration of a domain name and in allowing it to remain registered in the TLD, relies on the fact that you have agreed to these Terms.

4. Prices, payment & renewals

Prices are shown on the Site and may change. Payment is processed by our payment provider Stripe; you authorise us to charge the applicable fees. Domains are provided on a term basis and may be set to auto-renew; you are responsible for renewals to avoid expiry. Taxes (e.g. VAT) apply where relevant.

5. Refunds

New domain registrations may be refunded within a 4 calendar-day grace period after registration; renewals, transfers and services are non-refundable. See our Refund Policy for how to request a refund and other exceptions.

6. Acceptable use

You agree not to use the Services unlawfully; to infringe intellectual-property or third-party rights; to register or use domains for phishing, fraud, malware or other abuse; or to interfere with the Site's security or operation. We may take action, including suspension, for abuse, in line with registry and ICANN policies.

7. Intellectual property

The Site and its content (excluding your data and third-party marks) are owned by it.com Domains LTD or its licensors. ".ART" and related marks are trademarks of their respective owners. Nothing here grants you rights to our or others' intellectual property except as expressly stated.

8. Third-party services

The Services rely on third parties (registry, PDR/LogicBoxes, payment provider, Cloudflare, and others). Your use of domain registration is additionally governed by the registry and PDR/LogicBoxes terms. We are not responsible for third-party services beyond our control.

9. Disclaimers & limitation of liability

The Services are provided "as is" and "as available". To the maximum extent permitted by law we disclaim implied warranties and are not liable for indirect, incidental or consequential losses, or for loss of a domain due to expiry, registry action, or inaccurate registrant data. Nothing limits liability that cannot be excluded by law.

10. Indemnity

You agree to indemnify us against claims arising from your use of the Services, your domains/content, or your breach of these Terms or applicable registration policies, to the extent permitted by law.

11. Termination

You may close your account at any time. We may suspend or terminate access for breach, abuse, or where required by law or registry/ICANN policy. Provisions that by their nature survive termination will survive.

12. Governing law

These Terms are governed by the laws of England and Wales, and its courts have jurisdiction, without prejudice to mandatory consumer-protection rights you have in your country of residence. Registration-specific matters may additionally be governed by registry, ICANN and PDR/LogicBoxes rules.
